Synopsis from R' ShloimieWe explain that the case is a נסר, a board, on top of a תנור חדש, which the רא״ש explains is a תנור that was never used, so it is not yet a כלי. The board sticks out מכל צדדיו בפותח טפח, and since something that is not a כלי can be מציל, טומאה תחתיו, כלים שעל גביו טהורים, and טומאה על גביו, כלים שתחתיו טהורים.However, ובישן טמא. A תנור ישן, as the רא״ש explains, was already used, so it is מקבל טומאה and is a כלי. We learned in the beginning of פרק ו׳ that כלים can be an אהל to be מטמא but not to be מפסיק, so it cannot be מציל, and the טומאה goes through.Next, רבי יוחנן בן נורי מטהר even by a תנור ישן. The רא״ש brings the תוספתא that by כלים he agrees that they are not an אהל להציל, but he holds a תנור is different, and even a תנור ישן is not considered a כלי, so it can be מציל.Finally, the same הלכה by שני תנורים: if the נסר is נתון על פי שני תנורים, טומאה ביניהם, הם טמאים, and the רא״ש explains this is going by ישנים. The רא״ש asks what the חידוש of the סיפא is over the רישא. Synopsis from R' ShloimieWe explain that here the תנור is מוקף צמיד פתיל, and on top of it is a סרידה, a board that is מקבל טומאה. The רמב״ם says it is מקבל טומאה because it is a בית קיבול. Since it is מקבל טומאה it is not a חציצה, so טומאה תחתיו או על גביו, הכל טמא.Alternatively, at the end the רא״ש has a different שיטה: the סרידה has no rim, and without a rim it is not חשוב. If it had a rim it would be חשוב and could be a חציצה even if it were מקבל טומאה.Therefore, the only thing that is טהור is כנגד אוירו של תנור, since the תנור is מוקף צמיד פתיל and the טומאה does not go into it.Finally, טומאה כנגד אוירו של תנור, כנגדו עד הרקיע טמא, since טומאה רצוצה goes up. We note that what is inside the תנור stays טהור, because a כלי מוקף צמיד פתיל is מציל even on טומאה רצוצה.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Synopsis from R' ShloimieWe explain that a חדות, as the רא״ש says, is a kind of דוס. We heard before that a בור is a pit dug in the ground and a דוס is a built-up pit above the ground. Inside it is a מנורה, and its פרח, which the רמב״ם in פירוש המשניות explains is the top part of the מנורה where the oil and the נר go, sticks out of the דוס. A כפישה, a basket, is placed on top of it.Now the כפישה is a כלי, and we learned that a כלי can only be מציל עם דפנות אהלים, when it is next to an אהל. Here the דוס is the אהל, so the question is whether the כפישה on top is connected to the דוס, since the פרח is in between. Therefore the משנה says it depends. אם תנטל המנורה וכפישה עומדת על פי החדות, then we look at it as עם דפנות אהלים, and there is a מחלוקת. בית שמאי say החדות טהור, so the כלים inside it are טהורים, but the מנורה is טמאה. Briefly, as the רא״ש explains, בית שמאי look at the פרח, which is outside, so it is not saved. However, בית הלל say we go after the עיקר of the מנורה, which is inside the דוס, so it is saved, since the כפישה on top can be מציל עם דפנות אהלים.Finally, בית הלל agree that אם תנטל המנורה וכפישה נופלת, the כפישה needs the מנורה to hold it up, so it is not considered עם דפנות אהלים and cannot be מציל, and הכל טמא. אִם הָיוּ כָתְלֵי הֶחָדוּת רְחָבִים מִשֶּׁל בַּיִת, בֵּין כָּךְ וּבֵין כָּךְ טְהוֹרִים:Synopsis from R' ShloimieNext, כלים שבין שפתי כפישה לבין שפתי החדות, אפילו עד התהום, are טהורים, since the דוס is מציל and protects them from becoming טמא. However, if the טומאה is there, then הבית טמא.Then, טומאה בבית, and the כלים are in the walls of the חדות. If there is a place of טפח על טפח על רום טפח, they are saved and stay טהורים, and if not, they are טמאים. The רא״ש compares this to פרק ג׳ משנה ז׳, the ביב under the house: if it is טפח על טפח, what is inside it is טהור even though there is טומאה in the house. Finally, if the walls of the חדות are wider than the walls of the house, the כלים are basically outside the house, so בין כך ובין כך טהורים, even without טפח על טפח.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Mishna Yomi - Ohalos 11:6-7 - By R' Shloimie FriedmanL'uli Nishmas Etta Ahuva bas YaakovOct 21, 2026Wed10 Cheshvan 5787Ohalos 11:6-7Mishnah Ohalos 11:6משנה אהלות י״א:ו׳הַטֻּמְאָה בַבַּיִת וְהֶאֱהִילוּ עָלָיו טְהוֹרִין, בֵּית שַׁמַּאי מְטַהֲרִין, וּבֵית הִלֵּל מְטַמְּאִין:Synopsis from R' ShloimieWe explain that this is the same person lying on the אסקופה, half inside and half outside. In משנה ה׳ the טומאה was outside the house, and here הטומאה בבית, with טהורים outside who are מאהיל over him. בית הלל מטמאין, since a person is considered a חלל, so the טומאה goes out from underneath him, and whoever is מאהיל over him outside becomes טמא. Synopsis from R' ShloimieWe explain that this משנה is brought in the גמרא in חולין. כלב שאכל בשר המת means there is טומאת מת inside the dog. While the dog is alive it is טומאה בלועה בבעלי חיים, which is not מטמא. But once מת הכלב and it lies on the אסקופה, half in the house and half out, what is inside it can be מטמא, and there is a מחלוקת תנאים.First, רבי מאיר says אם יש בצוארו פותח טפח, meaning that squared off it would be טפח על טפח, it is מביא את הטומאה into the house, even when the בשר המת is outside. We explain that רבי מאיר follows his שיטה of חוקקין להשלים, which we find by a פתח in שבת and other places, so we look at the whole area as a חלל טפח.Next, רבי יוסי says the dog is not מביא את הטומאה, since there is no חלל טפח even if the צואר is a טפח. But מכנגד המשקוף ולפנים the house is טמא, because it is טומאה טמונה, and טומאה טמונה בוקעת ועולה.However, רבי אליעזר says פיו לפנים הבית טהור, פיו לחוץ הבית טמא, because the טומאה will leave the dog דרך שוליו, through the back side and not the mouth, so we look at it as if it went out that way. He agrees to סופה לצאת when the back faces the house, and even when the mouth faces the house, since the טומאה can also go out דרך כניסתה, the way it went in.Next, כמה תשהה במעיו? We bring the גמרא in שבת that since a dog has very little food, the הקב״ה made it keep its food in its stomach for up to three days. After that it is עפרא בעלמא.By עופות ודגים it is much less: כדי שתפול לאור ותשרף, after which it is already טהור, דברי רבי שמעון. רבי יהודה בן בתירא says מעת לעת, twenty-four hours, and after that it is no longer טומאת מת.Finally, the רא״ש says some wanted to be מתיר from here for פסח when a chicken ate wheat, as if it were already digested, so there is no problem of חמץ. He rejects this two ways: there is a חילוק between איסור and טומאה, and between בשר and חיטה.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Synopsis from R' ShloimieWe explain that the last משנה ended with the מחלוקת about a person lying on the floor: בית שמאי hold he is not a חלל טפח and cannot be an אהל, and בית הלל hold אדם חלול הוא. Our two משניות bring that same מחלוקת in two more cases, each just a different case.First, היה משקיף בעד החלון: a person leans his head out the window, and the front of his body is over קוברי המת who are burying a מת outside. בית שמאי אומרים אינו מביא את הטומאה, following their שיטה that the חלל of a גוף is not חשוב. Even though the גוף is attached to the window, we look at the upper part of the גוף, which has a חלל of a טפח, so it is מביא את הטומאה and the טומאה goes into the house. Finally, ומודים: בית שמאי agree that if he was לבוש בכליו, wearing his clothes, or there were שנים זה על גבי זה, two people one on top of the other, they are מביאין את הטומאה. Synopsis from R' ShloimieWe explain that here the person is lying on the אסקופה, the doorstep, part of him inside the doorway and part of him outside, and קוברי המת outside the house are מאהיל over him or over half of him.Again, בית שמאי say אינו מביא את הטומאה, because there is no חלל, and בית הלל say מביא את הטומאה.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Here there is no סוף טומאה לצאת, because it can go out through the open fourth side.Next, if the קנה was put not on top but on the ground, אינו מביא את הטומאה עד שיהא גבוה מן הארץ פותח טפח. If it is a טפח off the ground, the טומאה will go from the roof, underneath the קנה, to the other side. Finally, this is similar to what we had in the last פרק: once it is a טפח off the ground we say גוד אסיק, and it gets combined with the roof to be מביא את הטומאה. Synopsis from R' ShloimieWe explain that a סגוס עבה is a thick woolen garment, and a כפת עבה is something thick as well. אין מביאין את הטומאה עד שיהיו גבוהים מן הארץ פותח טפח: it is not good enough that the top is a טפח off the floor, but the bottom has to be, because since it is one thick thing, it is not considered a פותח טפח.However, קפולים זו על גבי זו, a טלית folded over, are different: once the עליונה is a טפח off the ground, it is מביא את הטומאה, even though there is no open space underneath. One thick כלי would not be good, but separate layers would be.Finally, the משנה ends with a מחלוקת about a person lying on the floor: do we say there is a חלל טפח there or not? בית שמאי say אינו מביא את הטומאה, because it is not a חלל טפח. בית הלל say אדם חלול הוא, his stomach area is hollow, and therefore the צד עליון is מביא את הטומאה. We note that this is only where there is a טפח, by his stomach, but not by the shoulder, where there is not a טפח.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

It is next to the אסקופה, outside the house, so that if we would pick up the pot a טפח it would go underneath the אסקופה and become one אהל together with it. The טומאה itself is outside the house.First, טומאה תחתיה, בתוכה או על גבה, when the קדרה is less than a טפח off the ground, is בוקעת ועולה בוקעת ויורדת, exactly like the last משנה.Next, when it is a טפח high, the הלכה is also the same as the last משנה: טומאה תחתיה או בבית makes the בית טמא, while תוכה וגבה stay טהור. If the טומאה is in the pot or on top of it, everything is טמא.Finally, all this is only when the קדרה is a טפח high and it overlaps the אסקופה. If it is less than a טפח, or it does not reach underneath the שקוף, the אהל just remains over there, because it is not considered one אהל together with the house. Synopsis from R' ShloimieWe explain that הבית שנסדק is a house with a crack across it, and the רא״ש explains that the crack is in the middle, dividing it in two.First, טומאה בחוץ, the כלים in the part deeper into the house remain טהור. However, if the טומאה is בפנים, there is an issue of סוף טומאה לצאת, since the only way for it to go out would be through the outer part, but on the other hand there is a crack. So the question is how big a crack is needed to say we don't care about סוף טומאה לצאת, and it is a three-way מחלוקת about the כלים שבחוץ. בית הלל say כל שהוא, so even a crack of any size makes the כלים שבחוץ טהור. רבי יוסי אומר משום בית הלל, פותח טפח: once the crack is a טפח, the כלים on the other side of the crack are טהור.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

The חילוק is when something is put on top. However, הטומאה בבית, whether he put a דבר שמקבל טומאה or a דבר שאינו מקבל טומאה, בין מלמעלן בין מלמטן, אין טמא אלא התחתון. Since the ארובה is less than a פותח טפח, טומאה that is not directly under the ארובה but spreads around the house will not go up to the top floor, as opposed to the last משנה.Next, הטומאה כנגד ארובות has the same חילוק we had in the last משנה. With a דבר שמקבל טומאה, בין מלמעלן בין מלמטן, הכל טמא, even when it is on the bottom. We note that the רמב״ם in פירוש המשניות says that something מקבל טומאה is not a חציצה, so we look at it as if it is on top, and the רא״ש also reads בין מלמעלן בין מלמטן as meaning both. Finally, with a דבר שאינו מקבל טומאה, בין מלמעלן בין מלמטן, אין טמא אלא תחתון, because something that is not מקבל טומאה is a חציצה. Synopsis from R' ShloimieWe explain that now we are back to a one-floor house with a ארובה, and a קדרה placed directly underneath it, שאם תעלה אין שפתותיה נוגעות בארובה: even if we say גוד אסיק and bring it up, it would not fit tightly and be one roof with the גג.First, טומאה תחתיה, בתוכה או על גבה, טומאה בוקעת ועולה בוקעת ויורדת. Here the קדרה is less than a טפח off the ground, so this is regular טומאה רצוצה that goes straight up and straight down, but the sides are not טמא.However, היתה גבוהה מן הארץ טפח, the קדרה itself is like an אהל. Even though a כלי cannot be an אהל, once we say גוד אסיק and bring it up to the top, it is considered an אהל.Therefore, טומאה תחתיה או בבית, underneath the קדרה and the whole house are טמא, but תוכה וגבה, inside the קדרה and directly above it up to the ארובה, remain טהור.Finally, if the טומאה was בתוכה או על גבה, by saying גוד אסיק the whole house, every place in it, is טמא.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Synopsis from R' ShloimieWe explain that in משנה א׳ the ארובה had a פותח טפח, and we learned at the end there that מקצת טומאה בבית ומקצתה כנגד ארובה makes the בית טמא and כנגד הטומאה טמא, since the טומאה still goes straight up even though it is less than a כזית, as part of a bigger כזית. Our משנה brings the same case באין בה פותח טפח.First, all three שיטות agree that הבית טמא, as in משנה א׳. The reason is that the אהל does not have to cover the entire כזית. As long as the אהל is over part of a כזית מן המת, it is already מטמא באהל.However, the מחלוקת is about what is above the ארובה, כנגד הטומאה. רבי מאיר says it is טמא, the same exact הלכה as the בית, since there too it does not have to go over the entire כזית.Next, רבי יהודה says הבית טמא, but כנגד הטומאה, since only מקצת of the כזית is under the ארובה, what is above it is טהור.Finally, רבי יוסי says that if there is enough טומאה to divide, a כזית in the בית and a כזית under the ארובה, both are טמא. But if there is only one כזית, הבית טמא and כנגד הטומאה טהור. So he agrees with רבי יהודה, except when there are two כזיתים, and then the whole כזית does not need to be under the ארובה. Synopsis from R' ShloimieWe explain that here we are talking about a two-floor house with two skylights, ארובות זו על גב זו, one underneath the other, and each has a פותח טפח.First, טומאה בבית, כנגד ארובות טהור, as we had in משנה א׳, and טומאה כנגד ארובות, הבית טהור.Next, if the טומאה was in the בית or under the ארובות and he put a דבר שמקבל טומאה to block the ארובה, בין מלמעלה בין מלמטה, whether on the second floor or the first, הכל טמא.Here there is a מחלוקת ראשונים between the רא״ש and the רמב״ם in פירוש המשניות, in how we translate בין מלמעלה בין מלמטה: whether only everything below is טמא, or, as is the פשטות, even when it is למטה, everything is טמא, even למעלה.Also, we ask what the סברא is, which is what the רא״ש is busy with when he does not like this פשט. If the טומאה is on the bottom floor and the thing is מקבל טומאה, it is not a חציצה, so the טומאה should go straight up. Why would the whole second floor be טמא? Because we look at it as if that thing is on the floor of the second floor, and therefore everything is טמא.Finally, if he put something that is אינו מקבל טומאה, which is a חציצה, התחתון טמא והעליון טהור: only the bottom floor becomes טמא, and the top floor remains טהור.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Most of the הלכות of משנה א׳ and משנה ב׳ are the same, so we point out where they differ.First, טומאה בבית: a כזית מן המת under the roof makes everything under the אהל טמא, but כנגד ארובה is not under the אהל, so it is טהור. This is the same even when the ארובה is less than a טפח, as we see in משנה ב׳.We note that the גמרא in סוכה דף ח׳ asks why we do not say לבוד here, and learns from this משנה that אין לבוד באמצע. The תפארת ישראל explains that by טומאה the הלכה is the דין of אהל, and לבוד was only said by מחיצות. The ריטב״א there learns the proof specifically from משנה ב׳, where אין בארובה פותח טפח.Next, טומאה כנגד ארובה goes straight up to the sky, and הבית טהור, again even when the ארובה is less than a טפח.However, נתן את רגלו מלמעלן, covering the ארובה with his foot, ערב את הטומאה, and the whole בית is טמא. Here the person himself is also טמא, since he is the אהל. This is where משנה ב׳ differs. Finally, מקצת טומאה בבית ומקצתה כנגד ארובה: even without a full שיעור in either place, the טומאה combines, so הבית טמא וכנגד הטומאה טמא. Synopsis from R' ShloimieWe explain that here Since the ארובה is less than a טפח, it is already considered סתום without him, so he is not part of the אהל.Next, הטומאה כנגד ארובה: רבי מאיר מטמא, because his foot becomes טמא at the same time that it makes the סתימה. וחכמים אומרים it depends: if the טומאה came first, he is טמא, but if רגלו קדמה את הטומאה, he is טהור.We note this is a little hard to understand. The תפארת ישראל brings other פשטים, but explains that a ארובה less than a טפח is considered סתום by anything on top of it, even his רגל. In the לשון of the רא״ש, נסתם הארובה מקודם, so the טומאה does not go up to his foot. Even רבי מאיר agrees when the טומאה is under the בית.Finally, רבי שמעון says that with שתי רגלים זו על גב זו that came before the טומאה, if the first is moved away and the second remains, it is טהור, since the first foot came before the טומאה. Even though the טומאה came before the second foot, the ארובה was already סתום מקודם.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

As the ראשונים explain, it is buried within rock or ground, so its surroundings are קרקע עולם.Therefore, רחבה מלמטן וצרה מלמעלן, הנוגע בה מלמטן is טהור, and מלמעלן, by the narrow כיסוי on top, is טמא. As the רא״ש says, only what is כנגד פיו is considered the ארון. Since the sides are קרקע עולם, we do not say the דין of קבר סתום on them, and only כנגד הכיסוי is טמא.Next, רחבה מלמעלן וצרה מלמטן: everything opposite the wide top is טמא. רבי יהושע says מטפח ולמטן טהור, מטפח ולמעלן טמא: only within a טפח of the opening is טמא, and below that it is קרקע עולם.We note there is a discussion whether רבי יהושע argues on all the cases of the משנה, or, since the cases are split up, only on this last case. Finally, העשויה כמין קמטרא, where the lid overlaps the sides, הנוגע בה מכל מקום טמא. כמין גלוסקוס, where the cover fits snugly within the דפנות, הנוגע בה מכל מקום טהור, חוץ ממקום פתיחתה, since only opposite the opening is the מקום הארון. Also, the רא״ש brings a תוספתא: one who builds a נפש על גבי קבר, הרי הנפש כולה כקבר סתום. Synopsis from R' ShloimieWe explain that this sounds similar to the כוורת earlier in the פרק, but here it is a חבית, which goes out on the sides: narrow at the top, widest in the middle, and narrow again at the bottom. Therefore, a כזית מן המת תחתיה או בתוכה כנגד קורקורתה, טומאה בוקעת ועולה בוקעת ויורדת, and the חבית is טמאה, since, as the רא״ש says, the opening is the same size as the שולים.However, תחת דפנה מבחוץ, under the part that goes out, טומאה בוקעת ועולה בוקעת ויורדת והחבית טהורה. Even כנגד the כזית it is טהור, because there is a הפסק between the אויר inside it and the אויר outside, like the כוורת מוטה על צדה earlier in the פרק, where the דפנות protect it.Next, בתוכה ותחת דפנה: if the part that goes out squares to a טפח על טפח, הכל טמא, but כנגד פיה is טהור, since there is no אהל there. ואם לאו, it goes straight up and down. Finally, במה דברים אמורים בטהורה: the whole משנה speaks of a חבית that cannot be מקבל טומאה, like the list in מסכת כלים פרק ב׳. But if it is טמאה, גבוהה מן הארץ טפח, מכוסה, or כפויה על פיה, it is as we learned at the end of משנה י״ג, הכל טמא.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Synopsis from R' ShloimieWe explain that these are the last two משניות about the כוורת. Again it is outside, not near a בית, but instead of מוטה על צדה, it is יושבת על שוליה, והיא כלי. As the רא״ש explains, there is nothing מפסיק between the אויר inside it and the אויר above it.Therefore, whether the טומאה is תחתיה, בתוכה, or על גבה, טומאה בוקעת ועולה בוקעת ויורדת, straight up and straight down. This is unlike משנה א׳, where the כוורת was מוקף צמיד פתיל, so טומאה on top went down under it but not into it. Here it stands on its שולים, so even בתוכה is טמא. With a טפח under the שולים it is an אהל, so the טומאה also spreads under the whole כוורת. Although a כלי cannot be חוצץ, it can be מביא טומאה, as we learned in פרק ו׳ משנה א׳, so הכל טמא.We may ask: the whole חילוק from משנה א׳ is that there is no הפסק, yet כפויה על פיה there is one. The רא״ש says the כיסוי is not מגוף הכלי, only a cover that is not firmly attached, so it does not protect what is inside.Still, the רא״ש says that if it is covered with a נסר, as we saw in his words on פרק ד׳ משנה א׳, it has the דין of צמיד פתיל and is מציל on בתוכה. Synopsis from R' ShloimieWe explain that במה דברים אמורים בזמן שהיא כלי refers to משנה י״ג. If it is פחותה ופקוקה בקש, or מחזקת ארבעים סאה כדברי חכמים, it is not a כלי, and for the רבנן there is no difference from משנה י״ג: טומאה בוקעת ועולה בוקעת ויורדת. טומאה inside does not go underneath, and טומאה underneath does not go in, since once it is not a כלי it can be חוצץ בפני הטומאה.Finally, היתה גבוהה מן הארץ טפח: with טומאה תחתיה, the whole area underneath is טמא. Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Synopsis from R' ShloimieWe explain that משניות י״א and י״ב go back to the cases of משניות א׳ through ח׳: א׳ through ד׳ were פיה לפנים, and ה׳ through ח׳ were פיה לחוץ. Now we learn the same cases באויר, not near a בית at all, תחת השמים, in a גינה or a חצר.In the first case, there is less than a טפח from the ground to the bottom of the כוורת, and the כוורת is a כלי, so it cannot be חוצץ. So whether the כזית is תחתיה or על גבה, whatever is כנגד הזית, above or below, is טמא.What is not כנגד הזית is טהור, even תוכה. Although as a כלי it cannot be an אהל to be חוצץ, it still has the דין of כלי המוקף צמיד פתיל, so what is inside is טהור.We had the same מחלוקת in משנה ד׳. According to the רא״ש, תוכה is טהור even כנגד הזית. According to the רמב״ם, what is opposite the זית is טמא, and תוכה טהור only means where it is not כנגד הזית.Finally, בתוכה הכל טמא: the טומאה goes out, spreads through the length of the כוורת, and everything opposite it, up to the שמים and down to the ארץ, is טמא, since it cannot be חוצץ. Synopsis from R' ShloimieWe explain that the second case is גבוהה מן הארץ טפח, still a כלי. So with the טומאה תחתיה, it spreads under the whole כוורת and goes up עד השמים. On גבה, it goes down, spreads under the כוורת, and goes back up. Only תוכה is טהור, as a כלי המוקף צמיד פתיל, and בתוכה הכל טמא. If it is פחותה, broken open, it is no longer a כלי. And here is a difference we did not have in the whole פרק: או מחזקת ארבעים סאה כדברי חכמים, that a כוורת holding ארבעים סאה is also not מקבל טומאה as a כלי.The רא״ש points out that in the whole פרק until now we did not say this. These רבנן argue on the entire פרק, holding that at ארבעים סאה it is בטל from טומאת כלי, so it can be מציל just like a פחותה. We note that there is a discussion of this in the רמב״ם in הלכות טומאת מת.Since it is not a כלי, a כזית תחתיה is מטמא כנגדו עד התהום but not above it, and על גבה, כנגדו עד הרקיע but not below. בתוכה, אין טמא אלא תוכה, since it is not a כלי and can be חוצץ.If it is גבוהה מן הארץ טפח, then בתוכה and על גבה are as before. The only חילוק is with טומאה תחתיה: the whole area underneath is טמא, not just what is directly under the כזית.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Synopsis from R' ShloimieWe explain that here the כוורת is not half in the בית and half out. It is entirely in the בית, ממלאה את כל הבית, up to the roof, with less than a טפח between it and the קורות.So טומאה בתוכה makes the בית טמא, but with טומאה בבית, what is inside it stays טהור, שדרך טומאה לצאת ואין דרכה להכנס. We had this יסוד in פרק ג׳ משנה ז׳, with a sewer pipe under a house, and in פרק ד׳ משנה א׳ and ב׳.The question is which case our משנה is most like. The רא״ש compares it to the sewer pipe: טומאה in the pipe makes the בית טמא, but טומאה in the בית leaves the pipe טהור. In פרק ד׳, with the מגדל, the רא״ש explains that since it is covered with a נסר, it can be מציל, and the טומאה in the בית does not go in.The תפארת ישראל learns that our כוורת has a דין כלי, and a כלי can be מציל עם דפנות האהל. Since the כוורת reaches the roof, or is within a טפח of it, it counts as עם דפנות האהל, so it is חוצץ and מציל on what is inside. But טומאה inside goes out, even from something מוקף צמיד פתיל, and is מטמא the בית. Those are two פשטים in the משנה.Next, בין עומדת בין מוטה על צדה: the same applies if it lies on its side with its פה within a טפח of the house's wall, which fits the last פשט. And בין אחת בין שתים: one כוורת on top of another, with less than a טפח between them. Synopsis from R' ShloimieWe explain that here the כוורת stands in the doorway, within a טפח of the משקוף. Unlike משנה ט׳, טומאה בתוכה leaves the בית טהור, because we view the משקוף as closing its opening. In the רא״ש's words, המשקוף יורד וסותם את פי הכוורת.With טומאה בבית, our גירסא says what is inside is טמא. The רא״ש is גורס טהור, שדרך הטומאה לצאת ואין דרכה להכנס, as he is in פרק ד׳ משנה ג׳, a similar case.To keep the גירסא of טמא, we learn that the כוורת fills the entire doorway, right and left, leaving no פותח טפח for the טומאה to get out of the בית, so it is מטמא what is inside. We are left to understand why the רא״ש did not learn it this way.Hebrew text from Sefaria (Torat Emet 357).Join our WhatsApp group (request to be added): https://chat.whatsapp.com/EanL7UBkpkQHzLKqNPfkcI

Here, היתה פחותה, it lost its שם כלי, so it can be מציל on what is inside it. It is פקוקה בקש, stuffed with straw, or אפוצה, with no טפח in any one place. So with a כזית מן המת underneath, כנגדו עד התהום is טמא, but inside it is טהור. Since it is no longer a כלי, it can be חוצץ for what is inside. The same goes for טומאה on top: כנגדו עד הרקיע is טמא, and inside is טהור.If the טומאה is בתוכה or בבית, the inside of the כוורת and the house share the same דין, since its opening faces in. With טומאה in either one, both are טמא. Synopsis from R' ShloimieThe only חילוק is that it is a טפח off the ground. Here, היה פיה לפנים, the opening faces into the בית, and the כזית מן המת is under it or on top of it, outside.Like משנה א׳, we are speaking where it has the הלכה of a כלי, and a כלי is not חוצץ. So the first הלכה is the same דין as משנה א׳: whatever is opposite the כזית, תחתיה and גבה, is טמא.We note that the next word, ותוכה, is not so פשוט. As we said on משנה א׳, the רא״ש held that תוכה is טהור even כנגד הכזית, because it is מציל on what is inside it מדין צמיד פתיל. But the גירסא here follows the רמב״ם: even though it is מציל, what is actually כנגד הכזית is טמא even inside. We cite the רב חיים, who explains the רמב״ם. Simply, the רא״ש is right that the גירסא should not have תוכה, since צמיד פתיל is מציל even כנגד the טומאה. But the רמב״ם holds that even though צמיד פתיל is מציל, the דין of טומאה רצוצה, which goes straight down, makes whatever is opposite it טמא, even though it doesn't actually bring the טומאה inside. With that, the רב חיים answers the כסף משנה's קושיא: once the טומאה goes into the barrel, why doesn't it spread and make the whole barrel טמא? The answer is that it doesn't really go into the barrel; there is just a הלכה that anything כנגדו is טמא, which is the דין of טומאה רצוצה.The second הלכה is the same as משנה א׳: כל שאינו כנגד הזית, תוכה והבית טהור, and here תוכה is certainly טהור, since it is מציל מדין צמיד פתיל.The only חילוק between משנה ה׳ and משנה א׳ is the last הלכה. In משנה א׳, with פיה לחוץ, טומאה in the בית made only the בית טמא, and טומאה בתוכה made only תוכה טמא. Here, since the opening faces the Synopsis from R' ShloimieWe explain that this is like משנה ב׳, with the כוורת a טפח off the ground. The only חילוק is that there it was פיה לחוץ, and here it is פיה לפנים.When the opening faced out, not toward the בית, טומאה under it, in the בית, or on top of it left תוכה טהור, since the טומאה had no way to go into it. Here it is stuffed up with no טפח, so the טומאה has no way to go from inside it to the בית.So with a כזית מן המת under it, כנגדו עד התהום is טמא, but above it is טהור, since it is חוצצת. On top of it, כנגדו עד הרקיע is טמא, but underneath is טהור.If the טומאה is in the בית, only the house is טמא. He notes our mishnah must be speaking where there is no טפח under the כוורת, since משנה ד׳ deals with a טפח, so it can't travel from the house to under the כוורת.Lastly, טומאה inside the כוורת makes only its inside טמא and everything else is טהור, since it is not מחולחלת, so it is able to be מציל. Synopsis from R' ShloimieHe explains that when there is a טפח from under the כוורת to the ground, טומאה under it or in the בית travels between those two areas, so תחתיה והבית are טמא, while תוכה וגבה are טהור, as in משנה ג׳.The only difference from משנה ג׳ is the פותח טפח at the bottom, so the house and the space under the כוורת share space and the טומאה goes from one to the other. With טומאה inside it, it is the same as משנה ג׳: אין טמא אלא תוכה, because it is not a כלי and it is מציל on everything else.Lastly, with טומאה on top, כנגדו עד הרקיע is טמא, again as in משנה ג׳, but underneath is טהור.Hebrew text from Sefaria (Torat Emet 357).

Here it is in the פתח with its opening facing outside, and the כזית מן המת is under it or on top of it, outside. He notes that משנה א׳ must be speaking where it is less than a טפח off the ground, since משנה ב׳ deals with a טפח. It is also מחולחלת, as משנה ג׳ says: it has holes the bees go in and out of, stuffed with קש but not tightly, as the רא״ש says.So כל שהוא כנגד הזית is טמא; the גירסא is really תחתיה וגבה, meaning directly under it and on top of it is טמא. What is not opposite the זית, תוכה, and the בית are טהור. Simply, תוכה is טהור even כנגד הזית, because of the הלכה of מוקף צמיד פתיל: anything within the כוורת is טהור.He notes one גירסא reads כל שאינו כנגד הזית תוכה טהור, but the רא״ש's גירסא is ותוכה, so three things are טהור: what is not כנגד הזית, תוכה even כנגד הזית, and the בית. According to that, the reason תוכה is טהור is מוקף צמיד פתיל.Even so, above and below are טמא: with the טומאה on top, what is under it is טמא as טומאה רצוצה that goes through, because the כוורת is a כלי, and a כלי cannot be an אהל. He notes that in the earlier פרק the מקור for this was always the כוורת: since it is a כלי, it is not חוצץ בפני הטומאה.He adds that he is simplifying; the רא״ש raises a קושיא on why what is in the כוורת is טהור, and answers יש לחלק.If the טומאה is in the בית, אין טמא אלא הבית. With the כזית inside the כוורת, הכל טמא: the טומאה leaves into the house through the holes, since they are not stuffed tightly, and the כלים under it and on top of it are טמא, because a כלי is not מציל on what is under it or on top of it.Mishnah Ohalos 9:2משנה אהלות ט׳:ב׳הָיְתָה גְבוֹהָה מִן הָאָרֶץ טֶפַח, טֻמְאָה תַחְתֶּיהָ אוֹ בַבַּיִת אוֹ עַל גַּבָּהּ, הַכֹּל טָמֵא, אֶלָּא תוֹכָהּ. Synopsis from R' ShloimieHere the כוורת is a טפח off the ground. With the טומאה under it, in the בית, or on top of it, הכל טמא: since there is a טפח, it is מטמא to the בית. He explains that the whole airspace under it is כמאן דמליא טומאה דמי, as if it were totally full of טומאה, so everything is טמא.The exception, אלא תוכה, is the inside of the כוורת, which is טהור because of צמיד פתיל.Lastly, with the טומאה inside the כוורת, it is the same as the end of משנה א׳: הכל טמא.Hebrew text from Sefaria (Torat Emet 357).

But an אהל in this פרק must be strong enough to hold a מעזיבה, while for סוכה even a thin סדין is a חציצה between the סכך and the שמים, so the two are not תלוי זה בזה.Following the רא״ש, דולג is said of a חיה and קופץ of a person. These, the flying bird, the flapping טלית and a boat floating on the water are all moving, so they are not an אהל.But a boat tied to something that can hold it, or a טלית weighed down by a stone, is מביא את הטומאה. He notes the גמרא in שבת brings this. תוספות there reads it as our mishnah: the issue is movement, so the שלשלת של ברזל is לאו דוקא ברזל, just anything that holds it firm. רש״י learns the סוגיא differently, with ברזל דוקא because of חרב הרי הוא כחלל, a גירסא that תוספות removes. On ר׳ יוסי, that the בית שבספינה is not מביא את הטומאה, the רא״ש gives two reasons: either it is while the boat is moving, or it cannot stand in a רוח מצויה. Synopsis from R' ShloimieHe notes this mishnah isn't connected to the rest of the פרק, but it is a nice הלכה. Two barrels, each with a חצי זית of a מת, sealed with a צמיד פתיל in one house, are טהור, but the house is טמא.The כלל is אין צמיד פתיל לטומאה: a צמיד פתיל only keeps something טהור in a כלי חרס from becoming טמא from the אהל המת, but טומאה inside it goes out. So the two halves combine into a כזית and everything in the house is טמא, while the barrels stay טהור, since the טומאה doesn't go back in.If one is opened, it and the house are טמא, but the other, still sealed, stays טהור, since טומאה from outside can't enter it.The same goes for two side rooms open to the house, each with a חצי זית: it goes into the house even with the door closed, because סוף טומאה לצאת, but not back into the rooms, so the house is טמא and the rooms are טהור.Hebrew text from Sefaria (Torat Emet 357).

These smaller כלים are מקבל טומאה, so they cannot be a חציצה.Likewise יריעה, סקורטיא, קטבוליא, סדין, מפץ and מחצלת not made as אהלים are not a חציצה. Dead animals are טמא and cannot block, and neither can אוכלים טמאים; the רמב״ם in פירוש המשניות explains that טמאים here includes food that is only הוכשר לקבל טומאה.The mishnah adds הרחים של אדם, a hand mill, which is מקבל טומאה and so cannot be a חציצה. Synopsis from R' ShloimieHe calls this the third category, חוצצין ולא מביאין: these can block טומאה but cannot spread it, because there is space in between. מסכת פרוסה is a weave with its strings spread out, and חבילי המטה are the spread-out ropes of a bed; they are not an אהל until woven together. The רא״ש explains משפלות as baskets used to carry out זבל, and the סריגות שבחלונות are the ropes across windows; these too can be a חציצה but are not מביא טומאה.Hebrew text from Sefaria (Torat Emet 357).

Second are יריעה, סקורטיא, קטבוליא, סדין, מפץ and מחצלת made as אהלים; the רא״ש brings from the גמרא in נדרים that סקורטיא is a leather garment. He brings תוספות in שבת, who asks why our mishnah doesn't contradict that כלל, since these are מקבל טומאה, and answers that they are made of משי. The רא״ש asks the same and answers that an אהל is different: once it has a שם אהל, even if it is מקבל טומאה, it is מציל from בוקעת ועולה.A herd of animals, טמאה or טהורה, and nests of חיה ועוף count, and for a resting bird the רא״ש holds it is a חציצה even if not tied down. In משנה ג׳ the animals are dead and טמא, so they cannot be. Vegetables such as אירוס, קיסום, ירקות חמור and דלעת יונית count too. For אוכלים טהורים the רא״ש explains they were not הוכשרו לקבל טומאה; ר׳ יוחנן בן נורי allows only an עיגול של דבילה, a cake of pressed figs. The רא״ש adds a חידוש: unlike the other items, which block whether the טומאה is above or below, the שידה, תיבה and מגדל work only from the side, since they are כלים. The case is a פתח טפח between houses or between a עליה and a בית, where a כלי is מציל together with the real אהל, like a קדירה stopping up a ארובה, and only when not directly over the טומאה. Synopsis from R' ShloimieHe describes the זיזין through the שננים as natural rock and stone formations. These, and the סככות and פרעות, are חוצצין ומביאין את הטומאה if they can hold a מעזיבה רכה per ר׳ מאיר, or a מעזיבה בינונית per the חכמים. סככות are a tree bent over the ground; פרעות stick out from a fence. The רמב״ם learns the mishnah is מחדש that the item must be strong enough to bear the מעזיבה put on it; without that strength it is not מביא את הטומאה. The רא״ש learns there is air space in between, and if it can hold the טיט we don't mind that it would fall through the gaps, so it is a חציצה, since the סככות and פרעות are dense.Hebrew text from Sefaria (Torat Emet 357).

Mishna Yomi - Ohalos 7:5-6 - By R' Shloimie FriedmanL'uli Nishmas Etta Ahuva bas YaakovOct 3, 2026Shab22 Tishrei 5787Ohalos 7:5-6Mishnah Ohalos 7:5משנה אהלות ז׳:ה׳יָצָא הָרִאשׁוֹן מֵת וְהַשֵּׁנִי חַי, טָהוֹר. Synopsis from R' ShloimieHe explains, following the רא״ש, that when the first twin is born dead and the mother is then taken out of the house, the live one born afterward is טהור, since the רא״ש brings the גמרא in חולין that טומאה בלועה אינה מטמאה.But if the live one came out first, the house is already טמא even if she leaves before the dead one is born: once the חי came out the רחם is open, and סוף טומאה לצאת. The רא״ש adds that this is a viable בן ט׳; a בן ח׳ would not be מקבל טומאה.The רמב״ם in פירוש המשניות explains the difference physically: if the dead one comes out first, the live one follows on its own without touching it; if the live one comes out first, the dead one will surely be drawn out with it and touch it, so the live child becomes טמא.He cites the well-known מגן אברהם in סימן שמ״ג, bringing the רוקח that a כהן's pregnant wife may enter a hospital because of a ספק ספיקא: maybe it is a נקבה, maybe a נפל. The מגן אברהם asks from our mishnah why a ספק ספיקא is needed, when טומאה בלועה is טהור anyway.Several answers are given, among them the אבני מילואים and the אחיעזר. The simplest is that the רוקח means she may give birth there, when she is close to her due date; then טומאה בלועה no longer helps, yet it is still מותר because of שמא נקבה and שמא נפל.According to ר׳ מאיר, twins in one שפיר make the house טמא, but in two separate שפירים it is טהור even if the live one came out first. The תנא קמא holds the house is טמא once the חי emerges and the קבר is open; ר׳ מאיר holds there is no טומאה until it comes out to the אויר העולם.He notes the גמרא in חולין records a מחלוקת תנאים, learned from פסוקים, whether an עובר במעי אשה is טמא. That is only once the קבר is open; if the רחם is closed, the עובר cannot become טמא, since it is like part of her body. Synopsis from R' ShloimieHe notes this mishnah is brought in the גמרא in סנהדרין. When a woman's labor endangers her life, the עובר is cut up and removed limb by limb, because her life comes first. He brings the big מחלוקת over the reason. רש״י in סנהדרין explains that until it comes out to the אויר העולם the עובר is not a נפש, so it may, and should, be killed to save the mother. The רמב״ם in פרק א׳ of הלכות רוצח holds the עובר is considered a רודף trying to kill the mother, and a רודף may always be killed.Once רובו has come out, or ראשו as the גמרא in סנהדרין says, and the רא״ש here gives the head the הלכה of רובו, אין נוגעין בו: it is like a born child, and אין דוחין נפש מפני נפש.The גמרא asks, according to רב הונא who holds a קטן הרודף may be killed, why the child isn't considered a רודף, and answers משמיא קא רדפי: the danger comes from Heaven, not from the child. He ends with a famous קושיא on the רמב״ם: if in the רישא the עובר may be killed because it is a רודף, why in the סיפא does the גמרא say it is not a רודף because משמיא קא רדפי?Hebrew text from Sefaria (Torat Emet 357).

He adds that the רמב״ם learns this mishnah too from the דין of קבר סתום, the topic that opened the perek. He asks whether this is דרבנן, as the wording of רש״י in ביצה suggests, or דאורייתא, as רש״י concludes there. It matters because the mishnah relies on ברירה, and we hold אין ברירה בדאורייתא; he leaves it as a question. If one door was opened, only it is טמא. Even a מחשבה to take the מת out through one door, or a window of ארבעה על ארבעה, is מציל on the others. בית שמאי require the מחשבה before death; בית הלל allow it even after. He brings two explanations from the גמרא in ביצה. Either they argue only מכאן ולהבא: for בית הלל only כלים brought in afterward are טהור, while בית שמאי hold that once טומאה rested on the doorway only a מעשה removes it, like כלים that become מקבל טומאה במחשבה but leave it only במעשה. Or they argue למפרע, and בית הלל hold יש ברירה, so even the כלים already there are טהור.For a sealed doorway, בית שמאי require opening ארבעה טפחים, while בית הלל say it is enough once he starts; both agree a brand-new opening needs ארבעה טפחים.He ends with a קושיא of תוספות in ביצה: if יש ברירה למפרע, the מת always leaves through some door, so when would the opening line, that all the doorways are טמא, ever apply? Synopsis from R' ShloimieThe case is a stillborn, which is מטמא as a מת, and the woman was moved from house to house. The first house is טמא only בספק, since, as the רמב״ם explains, the קבר may already have opened there; the second is טמא בודאי.Per ר׳ יהודה, this is only when her friends must carry her because she can't walk. If she is walking, the first house is טהור, because once the קבר opens she can no longer walk. He explains that קבר is the term חז״ל use for the רחם.He notes that the גמרא in שבת, brought by the רא״ש, has several שיטות on when פתיחת הקבר happens, such as when she is on the birthing bed, or when her friends carry her, which seems to be our mishnah. For נפלים, there is פתיחת הקבר only once the head is round like a פיקה, the knob of a spinning tool; the גמרא there discusses which spinning tool, for שתי or ערב.Hebrew text from Sefaria (Torat Emet 357).

Even though it sits in a טפח על טפח ברום טפח, it has nowhere to go, so it is a קבר סתום and is מטמא every עליה above it.When one עליה spans two houses and the wall stands between the lower rooms, that עליה is טמא, but its floor stops the טומאה from rising further. The רא״ש stresses this is only with a חלל of a טפח; without one, the sides stay טהור.For כותל שנית he follows the רא״ש: a solid wall with no חלל. Likewise a נפש אטומה, a solid מצבה over the קבר: with no טפח the sides are טהור, and with a טפח it is a קבר סתום.On the סוכות he brings two approaches from the תוספות יום טוב: either there is a טפח, so the טומאה spreads to the סוכות as it did to the עליות, or there is none and the סוכה becomes part of the קבר. Following the רא״ש, ר׳ יהודה מטהר because the נפש relates to the קבר, not to the סוכות. Synopsis from R' ShloimieHe explains that a sloped roof has the דין of an אהל even down to an אצבע. The רא״ש reads the case as טומאה in the flat part, which has a טפח על טפח ברום טפח; then כלים under the שיפוע become טמא even without a טפח there, and vice versa. He cites a view that even when both the כלים and the טומאה are under the שיפוע they are טמא, since the רא״ש treats that narrow area as if it were under the main אהל. He compares this to the רא״ש in סוכה, and notes that for טומאת אהל no flat טפח is needed.Touching the אהל on the side facing the טומאה is טומאת שבעה, like touching the מת. He gives two reasons: חרב הרי הוא כחלל, or, per רבינו תם who limits that to כלי מתכות, טומאה בחיבורין.The רא״ש explains that the inside and outside are like two separate כלים, since the אהל can be מציל and we don't say בוקעת ועולה. So the far side is only טומאת ערב, and with a חצי זית on each side, both sides are only טומאת ערב.A part that is מרודה on the ground is no longer an אהל for חציצה, so the טומאה goes straight up and down. On the ארובה, ר׳ יוסי holds it is מציל since there is air beneath it; ר׳ שמעון holds it is only an אהל when stretched with airspace underneath.Hebrew text from Sefaria (Torat Emet 357).

A בית המשמש את הכותל is judged כקליפת השום: as long as even a garlic-peel layer of wall remains, what's in the wall is not treated as in the house. The case is a wall between two כוכין or two מערות dug out underground: the digging on both sides leaves the wall standing, rather than it being built for a house. So with טומאה in the כוכין and כלים in the wall, or the reverse, a layer of קליפת השום keeps them טהור.He suggests the last case, טומאה תחת העמוד, fits better with the next mishnah: under a pillar from floor to ceiling, which could even be in a house, the טומאה goes straight up and straight down. Synopsis from R' ShloimieHe describes the פרח as a flower-like crown on top of a pillar, like those seen in the Old City, jutting out past its edge. According to the תנא קמא, כלים under the פרח are טהור.He calls the view of ר׳ יוחנן בן נורי a big חידוש: even with the טומאה under the עמוד, what is under the פרח is טמא. He cites the רא״ש that the פרח is like the עמוד itself, and since the top of the עמוד is טמא, what is under the פרח is too; he admits it's a bit hard to understand. When the טומאה and the כלים are both under the פרח, they are טמא if there is a טפח על טפח; if not, it is טומאה רצוצה that goes straight up, and they are טהור.He explains פרדסקים as hollow built-in closets in the wall of a house. If one opens into the house, it and the house are טמא, while the closed one stays טהור.In the last case, a closet that isn't open to the house is viewed as sealed, like the אטום at the end of משנה ה׳, as if it were a solid pillar or wall. Then it is judged מחצה למחצה, as earlier in the perek, depending on which side the טומאה is on.Hebrew text from Sefaria (Torat Emet 357).
